“Service” means access to wholesale pricing for goods offered by the Company on a subscription basis.
“Subscription Term” means the monthly billing interval, subject to a three (3) month minimum commitment.
You must be at least 18 years old and a U.S. resident to subscribe. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. One membership per individual; account sharing is prohibited.
The Subscription is billed monthly by default and AUTO-RENEWS until canceled. By subscribing, you authorize recurring monthly charges to your payment method at the then-current rate for your selected tier. We will present the key terms of the offer (price, billing frequency, minimum term, and cancellation method) clearly and conspicuously at checkout. Minimum Term: You agree to a minimum commitment of three (3) months.
Payment Method: Credit card. You authorize us and our payment processor to store your card details and to charge your card each billing cycle until canceled. If a payment attempt fails, we may retry and/or suspend access until payment is resolved.
Receipts & Notices: We will email a receipt after each recurring charge with clear instructions for how to manage or cancel your Subscription. If we ever offer a free/introductory trial or promotional pricing, we will send a renewal reminder before the first paid charge.
Taxes: Prices exclude applicable taxes and fees, which may be charged as required by law.
Pricing Changes: We may modify pricing with at least 30 days’ advance email notice. Continued use after the effective date constitutes acceptance.
You may cancel any time AFTER the three (3) month minimum by submitting a request BEFORE your next renewal date (the 1st of each month). Cancellation methods: (i) via any account “Manage Subscription” link (if available), or (ii) by emailing customerservice@gamandefense.com from your registered email. Early cancellation before the minimum term results in charges equal to the remaining amount of the 3‑month minimum. No refunds are provided for partial months or unused access.
All fees are nonrefundable except where required by law.
The Service provides access to wholesale pricing information and offers. We do not guarantee availability of any particular item, inventory levels, lowest prices, or that any order placed with third parties will be accepted or fulfilled. The Service may be temporarily unavailable due to maintenance or events beyond our control.
Personal Use Only: The Service and pricing information are provided for your individual, personal use. Resale or redistribution of pricing data is prohibited. You may not: (a) engage in unlawful activity; (b) access or use the Service to compete with us; (c) scrape, harvest, or automate access; (d) reverse engineer any part of the Service; or (e) infringe our or others’ rights.
All content, pricing data, and other materials are owned by Fortuna Global Enterprises, LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Service for personal purposes only.
Some goods accessible through the Service may be subject to federal, state, or local laws (e.g., age restrictions, background checks, FFL transfer, or export controls). You are solely responsible for complying with all applicable laws. Access to pricing does not constitute an offer or guarantee of sale, and any purchase is subject to separate terms from the applicable seller.
We may suspend or terminate your access (including for non‑payment, abuse, unlawful conduct, violation of these Terms, or for convenience). Upon termination, your access ends immediately and fees already paid are nonrefundable. Sections intended to survive (including payment obligations, IP, disclaimers, limitation of liability, and dispute provisions) will survive.
You consent to receive contracts, disclosures, and notices electronically at the email you provide. By clicking “Agree & Subscribe,” you affirm that you can access and retain electronic records and that you consent to use of electronic signatures and records. You may withdraw consent by contacting support, which may impact your ability to use the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Fortuna Global Enterprises, LLC and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of law.
These Terms are governed by Texas law. Exclusive venue for disputes is the small claims court of competent jurisdiction located in Texas. TO THE EXTENT PERMITTED BY LAW, YOU AND WE WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN CLASS OR REPRESENTATIVE ACTIONS.
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, outages, or government actions. No penalties apply during a force majeure event.
We may update these Terms. We will notify you by email of material changes. Your continued use after notice constitutes acceptance.
Severability: If any provision is invalid, the remainder remains in force.
Assignment: You may not assign your rights without our consent; we may assign to an affiliate or in connection with a transaction.
No Waiver: Failure to enforce a provision is not a waiver.
Entire Agreement: These Terms are the entire agreement regarding the Service. Headings are for convenience only.
This Privacy Policy explains how Fortuna Global Enterprises, LLC (“Company,” “we,” “us,” or “our”) collects, uses, shares, and safeguards personal information in connection with the Service.
Identifiers (e.g., name, email, phone); account and subscription details (tier, status); commercial information (order history with third parties, if shared with us); and technical data (IP address, device, general location, and usage logs). Payment card data is collected and processed by our payment processor; we do not store full card numbers.
Directly from you (forms, account creation, support); automatically from your device/browser; and from service providers (e.g., payment processors, fraud prevention, analytics).
To provide and bill for the Service; authenticate users; communicate about your account; prevent fraud and misuse; comply with law; and improve the Service. We may send transactional emails (e.g., billing receipts). Marketing emails are optional and may be opted out at any time.
We share personal information with service providers who process data on our behalf (e.g., payment processing, hosting, analytics, communications); with authorities when required by law; and in connection with a business transaction (e.g., merger or asset sale). We do not sell personal data as that term is defined under the Texas Data Privacy and Security Act (TDPSA).
We may use cookies and similar technologies for essential site functionality, performance, and basic analytics. Where required by law, we will honor Global Privacy Control (GPC) or similar universal opt‑out signals.
Depending on your state of residence (including Texas), you may have rights to: (a) confirm whether we process your personal data and access it; (b) correct inaccuracies; (c) delete personal data; (d) obtain a portable copy; and (e) opt out of sales, targeted advertising, or certain profiling. To exercise rights, email customerservice@gamandefense.com with the subject line “Privacy Request.” We will respond within 45 days, subject to lawful extensions, and provide an appeals process if we deny your request. Authorized agent requests will be honored as required by law.
We implement reasonable technical and organizational measures to protect personal information. No method of transmission or storage is 100% secure.
We retain personal information for as long as needed to provide the Service, comply with law, resolve disputes, and enforce agreements, then delete or de‑identify it.
The Service is intended for individuals 18 and older and is not directed to children. We do not knowingly collect information from children.
The Service is intended for U.S. residents. If you access the Service from outside the U.S., you consent to the transfer of your information to the United States.
We may update this Policy from time to time. We will notify you of material changes by email.
